Canton Man learns punishment for causing fatal traffic scrench in 2023

Canton-a 27-year-old Stadsman has been sentenced to 270 days in prison for charges arising from a crash with two vehicles from 2023 that another driver killed.

Austin N. Hayhurst, 27, was convicted on Tuesday in Canton Municipal Court for his role in a traffic scrench on 11th Street SW that caused the death of Shanell J. Backie.

Judge Richard J. Kubilus found Hayhurst guilty after Hayhurst did not argue to mislead murder of vehicles and the charges of vehicles.

A Canton Police report on the crash said that on July 7, 2023 Hayhurst was in a Nissan Juke SUV from 2013 in a Nissan Juke SUV on Maryland Avenue SW, when he turned left to 11th Street. He was unable to surrender to a 2010 Nissan Altima, powered by Backie, also from Canton, who was north on Maryland. The Altima ran off the road and hit a parked vehicle.

Backie was paralyzed by the crash and died as a result in the Aultman Hospital on March 9, 2024, court reports. She was 39.

Kubilus gave Hayhurst the honor against his sentence already spent 12 days in the Stark County prison. He ordered the suspect to pay $ 468 fines and costs, his driver’s license has been suspended for five years and six points in his driving record. The judge ordered Hayhurst to evaluate and follow the recommendations of the probation department for counseling. Kubilus ordered the payment of a refund.

The reimbursement amount is determined by the probation department after the victim’s family has submitted documents about the own costs of Backie’s care, said Kristina M. Lockwood, main assistant Canton Canton.

Court reports show that Hayhurst recently lived at Worley Avenue NW.

A message was sent on Tuesday to Hayhurst’s lawyer Michael Smith, a public defender. The office of the Stark County Public Defender does not regularly comment on the customer’s affairs.
