Jury finds man guilty of assault on Kalispell police officer

Mar. 5—A jury has found a man accused of wounding police during a fight outside a homeless shelter in Kalispell in October guilty of assaulting a peace officer late last month.

Prosecutors filed misdemeanor charges against Joshua William Myers-Starks, 37, for headbutting and punching a Kalispell police officer on Oct. 17, leaving the officer with lacerations to the officer’s left ear and forehead, swelling to his face and bruises spots under his eye. According to court documents, a medical evaluation later indicated the officer may need surgery for a potentially serious pectoral muscle injury.

Officers arrested Myers-Starks at the urging of staff at the North Meridian Road shelter, who reported him for allegedly setting objects on fire, according to court documents. He was warned about his behavior the day before, according to court documents.

Myers-Starks pleaded not guilty to the crime during his arraignment on Nov. 16.

The Feb. 23 verdict followed a three-day trial presided over by Judge Robert Allison in Flathead County District Court. The jurors began deliberating on February 22 at approximately 1:30 p.m.

Deputy County Attorney Larissa Malloy prosecuted the case, while attorney Liam Gallagher represented Myers-Stark.

Allison set sentencing for April 12.

Myers-Starks also faces a burglary charge in a separate case in district court. Prosecutors have accused him of breaking into the store of a Kalispell tobacconist in December 2022, smashing a drive-thru window and stealing candy. He pleaded not guilty to the charges in January 2023 and the case went before a jury in July but ended in a mistrial.
