News-Press obtains documents for the guidelines of Lee County Schools for dealing with ice agents

After a recent federal directive that allows immigration enforcement to schools, the school district of Lee County has issued detailed guidelines to help staff navigate potential interactions with immigration and customs enforcement (ICE) agents.

Last week the district published a statement to staff and parents who confirm its legal obligations, but did not stop when providing specific procedures.

Documents obtained by the News-Press sketch clearer protocols for how the district expects schools to react when ice agents arrive at campus.

These guidelines were developed after the reversal of the Trump government policy that limited enforcement actions at “sensitive locations” such as schools.

What is the protocol for handling ice officers at Lee County Schools?

The district has issued guidelines and asked managers to share them with staff to ensure that everyone is aware.

According to these guidelines, school directors are the most important contact point for ICE agents.

The district also suggested that every main advisor would be trained on these protocols:

  • When an ice agent arrives at a school that asks for a student, the manager must first verify their identity by asking for identification, such as badges, photo -IDs and business cards.

  • The district then instructs managers to write down these login details or to make copies and to register the name of the agent, the badge number, contact details and the telephone number of the supervisor.

  • It is also crucial to inquire about the reason for the presence of the agent on school grounds and to request relevant paperwork, such as arrest statements or judicial orders.

  • Before granting access, school staff must inform the agent that the legal adviser must revise the request.

  • Unless there are a fixed circumstances, an agent must obtain a judicial order issued by a federal court and signed by a federal court. The guidelines are also in accordance with Board Policy 5540 for maintaining the law enforcement that students interview.

What are the steps for interviews with students and parental notification?

As legal adviser ICE agents gives access, managers must:

  • Contact the ICE agent to see if the parent can be contacted before the student’s interview or arrest. If the agent confirms that contact with parents can be contacted, the manager must call the parent.

  • If the ICE agent indicates that a parent should not be contacted, the manager must ask the student to stay with the student during the interrogation. However, if the ICE agent states that the manager cannot stay, the manager must leave the House and allow the agent to interrogate the student alone.

  • If a student is arrested, the manager must immediately inform the parent and provide the contact details of the agent. The administration must also immediately inform the regional and district inspections.

  • Document all the efforts to inform the parents and all the events that occurred during the visit.

What are the legal considerations for staff?

The guidelines also outline legal precautions for school staff:

  • Do not physically block an agent, even if they seem unauthorized.

  • Failure to comply with instructions during a federal investigation can lead to serious consequences, such as an arrest for messing around with the investigation or the obstacle of justice.

  • Examples of non-compliance include informing a parent about an interview when an agent has specifically instructed not to do so, refuse to leave the House when asked if the arrest of a person agent is disturbed.

  • Individuals have the right to self -accusation and cannot be forced to provide information.

How are schools advised to deal with the well -being of students in the case of parental detention?

If school staff becomes aware that the parents of a student have been held, but the student did not do so, they must inform the administration to determine the student’s living situation and to call the Ministry of Children and Families.

If a student has no legal guardian and no documentation has been submitted for a delegation of parental responsibility, contact must be made.

What is the policy of Lee School District in the field of student records and ICE SAverseningen?

The Lee County School District claims that it does not collect documentation with regard to the immigration status of a student during registration and therefore have no documents with regard to immigration status. However, schools are advised to prepare for summons with human trafficking or related issues.

If an agent presents a summons for student records, it must be forwarded to the Office of Legal Services for guidance and processing. According to the federal law, personally identifiable student information in educational records cannot be released without the prior written permission of the parents, a legally issued summons, a judicial order or in an emergency for health or safety. In such cases, parents and students must be informed by the educational institution or agency before they release records.
