Trotwood man accused of shooting dead man repairing ATV charged with murder

Sept. 16 – A Trotwood man charged with murder Monday is accused of fatally shooting a man as he tried to repair an ATV that broke down in the parking lot of a Trotwood apartment complex earlier this month.

Timothy Lynch, 40, is due in Montgomery County Superior Court on Thursday on suspicion of two counts of murder and two counts of assault.

Lynch is charged in the Sept. 5 shooting death of Erick Quiroz-Rivas.

A Trotwood police officer was filling up his car with gas when he heard a gunshot. Shortly after, around 7:30 p.m. on Sept. 5, police and paramedics were dispatched to the 8000 block of Belle Creek Lane, at the Belle Meadows Apartment Complex on Shiloh Springs Road.

Emergency responders found a man, later identified as Quiroz-Rivas, with a life-threatening gunshot wound. He was taken to Miami Valley Hospital, where he died, according to police and Montgomery County Coroner Dr. Kent Harshbarger.

Witnesses said the shooter, identified as Lynch, left on a motorcycle and was apprehended by a police car.

Quiroz-Rivas and a second man were riding ATVs in the parking lot of the apartment complex when one of the four-wheelers broke down. As the two tried to fix the ATV, Lynch came outside and told them to leave, police said. Lynch then went back inside, retrieved a firearm, came back outside and fired a single shot, striking Quiroz-Rivas, according to the Montgomery County Prosecutor’s Office.

Lynch is being held in Montgomery County Jail on $1 million bail.
