Adam Montgomery demands review of sentence for daughter’s murder

June 5 – Adam Montgomery, convicted of killing his 5-year-old daughter Harmony, seeks a review of his sentence from 56 years to life in prison.

His application will be reviewed by the three-member Sentence Review Board, which could be done with or without a hearing.

Such a review may result in an increase or decrease in the penalty, or there may be no change.

The sentence handed down by Judge Amy Messer last month calls for 45 years to life in prison for the murder and an additional 11 years for the convictions of second-degree assault, tampering with physical evidence, witness tampering and abuse of a corpse.

During a three-week trial, prosecutors presented evidence showing Montgomery beat Harmony to death after a toilet accident in December 2019.

Montgomery did everything he could to cover up his crimes, including threatening and beating his wife Kayla, and had a lengthy criminal record, prosecutors said.

Public defender Caroline Smith said Montgomery was unable to show remorse during the sentencing hearing because he maintains he is innocent of the murder.

Montgomery admitted at trial to abusing a corpse and falsifying physical evidence.

Harmony’s remains have never been found.

The review falls outside the appeal procedure to the Supreme Court.
