For many, fireworks are the literal highlight of the Fourth of July celebration. Capping off a day of barbecues, music and summer fun, celebrating the birth of our nation with a literal bang.
We all know the hassle of getting there early to get the best seats, getting some friends and family into the car, and waiting for hours in the summer heat. Knowing all this, you might be wondering: why not just have your own fireworks show in your backyard?
If you’re asking that question, it means it’s time for a new 4th of July tradition, folks — a refresher course on the do’s and don’ts of personal fireworks in Rhode Island.
Which fireworks are legal in Rhode Island?
According to the Office of the State Fire Marshal, only ground-based devices and sparklers are legal for use by the general public – in this case, that means 16 years or older. These include:

Ground-based and hand-operated sparkling devices

Fountains

Illuminating torches, wheels, spinners, glittering stars

Sparklers, party poppers, snappers, toy smokers, snakes, glow worms, wire sparklers and dim sticks
However, anything with an aerial component is not allowed. Rhode Island General Law states that no person shall sell, use, or possess aerial fireworks or consumer fireworks.

If the firework goes into the air, fires inserts or projectiles into the air, explodes or makes a loud noise, it is not on the ground and therefore illegal. This also applies to sky lanterns. The Fire Marshal’s website explains that an audible crackling sound is not considered such a sound, the report states.
How old do you have to be to buy fireworks in Rhode Island?
State law states you must be 16 years old to purchase fireworks in Rhode Island.
What are the possible penalties for setting off fireworks in Rhode Island?
The sale, use or possession of fireworks is a criminal offense under Title 11, Chapter 13 of the state law and violation thereof is considered a misdemeanor.
You can be fined up to $1,000 and jailed for up to one year for each violation. If you would like to file a complaint or report the use of illegal fireworks, please contact your local police department. Do not call 911 to report fireworks or loud noises.
Where can you buy fireworks in Rhode Island?
With these rules and regulations in mind, Rhode Island has many places where fireworks are sold legally. The nation’s largest fireworks retailer, Phantom Fireworks, has locations in Cumberland, Johnston, North Providence, North Smithfield, Warwick and West Warwick. Other major stores include Firework Connection in Tiverton, TCS Fireworks in Woonsocket and Fireworks RI in Coventry, East Providence, Warren, Warwick and Woonsocket.
