PLYMOUTH — A Brockton man pleaded guilty Wednesday to a manslaughter charge in connection with a 2018 shooting that left a 21-year-old man dead, officials said.
Andrew Tymek, 26, pleaded guilty Wednesday, Dec. 4, in Plymouth Superior Court to manslaughter, assault with a deadly weapon, malicious wounding of a motor vehicle, unlawful possession of a firearm, unlawful possession of a loaded weapon, firearm and unlawful discharge of a firearm within 500 feet of a building, Plymouth County District Attorney Timothy J. Cruz announced in a written statement.
The charges stem from the June 8, 2018, drive-by shooting death of 21-year-old Anthony Baker. Baker was shot and killed not far from his home on Intervale Street on Brockton’s north side.
Tymek and co-defendant Christopher Nogueira, 27, of Taunton, were both charged in connection with the fatal incident.
What happened on the day of the murder
On June 8, 2018, just after 6 p.m., Brockton Police received multiple 911 calls for reports of a shooting on Arthur Street. Upon arrival at 10 Arthur St., Brockton police found Baker lying “unresponsive” in the street, the district attorney’s office said. Emergency medical personnel took him to Good Samaritan Medical Center, where he was pronounced deceased, officials said.
Baker, known to his family as “Junior,” was coming home to his Intervale Street apartment when he was shot, his mother told The Enterprise in 2018.
Brenda Baker said she crossed the street after hearing gunshots and watched her son take his last two breaths.
“I said, ‘Junior, please open your eyes and breathe,’” Brenda Baker said.

The police investigation
Brockton police contacted Massachusetts State Police detectives assigned to the Plymouth County District Attorney’s Office and a murder investigation was initiated. As part of the investigation, police learned that the victim and Tymek previously knew each other, and that there was an ongoing feud between the men and their respective circles of acquaintances, the district attorney’s office said in the written statement.
District attorney’s office spokesperson Beth Stone said in 2018 that state police and Brockton police detectives worked “around the clock” in the hours after the shooting.
At his arraignment in 2018, the district attorney’s office said the drive-by shooting was the result of an “ongoing feud” over ex-girlfriends between Tymek and Baker.
Taunton’s co-defendant was found not guilty
Christopher Nogueira was originally charged in 2018 with murder, unlawful possession of a firearm, unlawful possession of a loaded firearm and unlawful discharge of a firearm within 500 feet of a building.
A Plymouth County jury found Nogueira not guilty of all charges related to the fatal shooting on Nov. 27 in Brockton Superior Court, the district attorney’s office said in the written statement.
Tymek conviction
Superior Court Judge William Sullivan sentenced Tymek to 15 to 18 years in state prison.
Second Assistant District Attorney Jennifer Sprague prosecuted Tymek’s case, which was investigated by State Police detectives assigned to the Plymouth County District Attorney’s Office and the Brockton Police Department.
