Davison County felony court cases for Nov. 19

Nov. 21—MITCHELL — The following cases were among those heard Tuesday, November 29, during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:

* Matthew Sherman, 35, of Chamberlain, pleaded not guilty to possession of a controlled substance, a Class 5 felony, and to unauthorized manufacturing/distribution of methamphetamine, a Class 3 felony. His request for a personal recognizance (PR) bond was granted. A jury trial is scheduled for February.

* Alexandrea Gingrich, 30, of Baltic, pleaded guilty to impersonation to deceive a law enforcement officer, a Class 1 misdemeanor. As part of a plea agreement, two other charges were dismissed: use or possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance, a Class 5 felony. Gingrich was sentenced to 30 days in jail, with 29 days suspended and credit given for one day already served. She was also ordered to pay a fine of $350.

* Andrea Buchholz, 32, of Mitchell, admitted to a parole violation. As part of a plea agreement, multiple charges in a separate matter were dismissed, including domestic abuse, a Class 1 misdemeanor; a fourth offense domestic abuse simple assault and possession of a controlled substance, both Class 5 felonies. She received credit for 54 days previously served. She was ordered to restart a two-year probation sentence.

* Trevin Gardner, 19, of Mitchell, pleaded not guilty to multiple charges, including use or possession of drug paraphernalia and open alcoholic beverage container, both Class 2 misdemeanors; obstructing police, reckless driving, and eluding, Class 1 misdemeanors; and grand theft of a firearm valued at $2500 or less, a Class 6 felony. Gardner was granted a PR bond. A jury trial is scheduled for March.

* Brandi Allen, 27, of Mitchell, appeared in court for a status hearing regarding multiple charges, including obstructing police and resisting arrest, both Class 1 misdemeanors, as well as simple assault against a law enforcement officer, a Class 6 felony. Allen currently faces additional pending charges. A jury trial was rescheduled for February.

* Dillon Phillips, 19 of Mitchell, pleaded guilty to possession/manufacturing/distribution of child pornography and to one count of possession of child pornography, both Class 4 felonies. As part of a plea agreement, nine additional counts of child pornography possession were dismissed. The court mandated that Phillips undergo a sexual psychological evaluation before sentencing. Both counts carry a minimum one-year sentence and require Phillips to register as a sex offender. A request for bond modification was denied.

* Ryan Anderson, 45, of Mitchell, pleaded guilty to possession of a controlled substance (cocaine, a Class 5 felony. As part of a plea agreement, three other charges were dismissed, including conspiracy to manufacture/distribute/possess drugs, a Class 4 felony, and unauthorized ingestion of a controlled substance and maintaining a place for the use or sale of a controlled substance, both Class 5 felonies, were dismissed in the plea agreement. Anderson faces up to five years in prison and/or a $10,000 fine. His sentencing is scheduled for January.

* John Hofer, 53, of Sioux Falls, pleaded guilty to possession of a controlled substance (meth), a Class 5 felony. As part of a plea agreement, charges for renewal registration during the assigned month and use/possession of drug paraphernalia, both Class 2 misdemeanors, were dismissed. The court ordered a presentencing report. Hofer’s sentencing is scheduled for December.

* Risa Sanborn, 43, of Lower Brule, pleaded not guilty to possession of a controlled substance, a Class 5 felony, and unauthorized manufacturing/distribution/counterfeiting of methamphetamine, a Class 3 felony. A jury trial is scheduled for February.

* Teresa Chipps, 18, of Rapid City, pleaded guilty to grand theft involving an amount between $2,500-$5,000, a Class 4 felony. Chipps was sentenced to two years in prison, with all time suspended. She received credit for 28 days already served. Additionally, she was placed on two years of probation.

* Gerald Chernotik, 55, of Mitchell, pleaded guilty to entering or surreptitiously remaining in a building, a Class 1 misdemeanor, and petty theft valued at less than $400, a Class 2 misdemeanor. As part of a plea agreement, charges of second-degree petty theft, a Class 1 misdemeanor, and first-degree burglary, a Class 2 felony, were dismissed. Chernotik received a sentence of 180 days in jail, with 77 days suspended and credit for 103 days already served. He was ordered to pay a $300 fine and $400 in restitution. Additionally, he received a 30-day jail sentence, with all time suspended.

* Larry Anderson, 30, of Mitchell, pleaded guilty to possession of a controlled substance (meth). As part of a plea agreement a Class 2 misdemeanor charge for use/possession of drug paraphernalia was dismissed. Anderson was sentenced to five years in prison, with credit for six days already served. All time was suspended. He was also ordered to pay a $750 fine and serve two years on probation.

* Jordan Scheel, 33, of Mitchell, pleaded guilty to possession of methamphetamine and third-degree burglary. As part of a plea agreement, charges of possession of drug paraphernalia and second-degree petty theft,both Class 2 misdemeanors, as well as a grand theft charge involving an amount between $2,500 and $5,000, a Class 5 felony, were dismissed. Judge Giles ordered a pre-sentence report. Scheel is scheduled to be sentenced in December.

* Matthew Weddell, 44, of Mitchell, pleaded not guilty to a grand theft charge involving an amount between $2,500 and $5,000. The court upheld a $1,000 bond. A jury trial is scheduled for March.

* Giovonna Abate, 33, of Northglenn, Colorado, pleaded not guilty to several charges, including domestic abuse simple assault, a Class 1 misdemeanor; possession of drug paraphernalia, a Class 2 misdemeanor; and two counts of a controlled substance, one for Alprazolam, a Class 6 felony, and one for cocaine, a Class 5 felony. A jury trial is scheduled for March.

* Brayan Duran-Escobar, 19, of Mitchell, failed to appear in court on a fourth-degree rape charge. A $5,000 bench warrant was issued. Court documents indicate that the alleged victim was 14-years-old.

* Courtney Brown, 39, of Sioux Falls, appeared in court on charges of petty theft involving an amount greater than $400, a Class 1 misdemeanor, and identity theft, a Class 6 felony. Due to additional charges pending in Brule County, a jury trial originally scheduled for December has been rescheduled to February.

* Jarad McGhee, 24, of Mitchell, pleaded guilty to eluding, a Class 1 misdemeanor. As part of a plea agreement, two Class 1 misdemeanor charges, driving with a revoked license and reckless driving, along with a Class 6 felony charge of aggravated eluding, were dismissed. He was sentenced to 60 days in jail, with all time suspended. He was also ordered to pay a $350 fine.

* Patrick Ross, 51, of Canton, pleaded guilty to grand theft involving an amount between $5,000 and $100,000. Court documents reveal that Ross wrote a check for $68,150 to Goldie’s Auto and Trailer for two trailers, but the check was returned due to insufficient funds. Sentencing was delayed for two weeks to determine the restitution amount.

* Emily Ortiz, 22, of Sioux Falls, pleaded guilty to distribution of a controlled substance (meth), a Class 4 felony. As part of a plea agreement, charges of possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance, a Class 5 felony, were dismissed. Ortiz was sentenced to ten years in prison, with six years suspended and credit for 158 days already served. She was also ordered to pay a $1,000 fine.

* Jesse Puepke, 60, of Mitchell, pleaded guilty to unauthorized ingestion of a controlled substance (meth), a Class 5 felony. As part of a plea agreement, charges of possession of drug paraphernalia, a Class 2 misdemeanor, possession of two ounces or less of marijuana, a Class 1 misdemeanor, and a habitual offender charge were dismissed. Puepke was sentenced to five years in prison, with all time served and credit for nine days already served. He was also ordered to pay a $750 fine and serve two years on probation.

* Tina Mann, 49, of Hammond, Minnesota, pleaded guilty to possession of a controlled substance (cocaine), a Class 5 felony. As part of a plea agreement, charges for possession of meth, a Class 5 felony; possession of two ounces or less of marijuana, a Class 1 misdemeanor; possession of drug paraphernalia and an illegal lane change, both Class 2 misdemeanors, were dismissed. Mann was sentenced to six days in jail, with credit for one day already served. She was also ordered to pay a $750 fine and serve two years on probation.

* Venessa Guevara, 32, of Mitchell, pleaded guilty to a third-offense driving under the influence (DUI) charge, a Class 6 felony. As part of a plea agreement, two Class 2 misdemeanor charges, open alcoholic beverage container and driving without a license, were dismissed. Guevara was sentenced to two years in prison, with all time suspended, and 11 days in jail, with credit for one day already served. She was also ordered to pay a $600 fine.

* Brooke Lyon, 44, of Sioux Falls, pleaded guilty to a third-offense DUI charge, a Class 6 felony. As part of a plea agreement, a class 2 misdemeanor charge of careless driving was dismissed. Lyon was sentenced to two years in prison, with all time suspended, and ordered to pay a $600 fine. She was also sentenced to two years on probation and had her driver’s license revoked for one year. A request for a suspended imposition of sentence was denied.

* Justine Keegel, 29, of Platte, pleaded guilty to possession of a controlled substance (meth), a Class5 felony. As part of a plea agreement, a Class 2 misdemeanor charge for possession of drug paraphernalia, was dismissed. Keegel was sentenced to five years in prison, with all time suspended and credit for 28 days already served. She was also ordered to pay a $750 fine and serve two years on probation.

* Majda Korkutovic, 32, of Letcher, failed to appear in court on charges of second-degree burglary, a Class 3 felony, and unauthorized ingestion of a controlled substance, a Class 5 felony. Korkutovic is currently undergoing treatment as part of a competency restoration program. The case was continued until January.

* Joseph Moyer, 42, of Huron, had a status hearing regarding charges of possession of a controlled substance (meth), a Class 5 felony, and possession of drug paraphernalia, a Class 2 misdemeanor. The case was continued for two weeks.

* Bobby Lunsford III, 24, of Mitchell, pleaded guilty to simple assault, a Class 1 misdemeanor. As a part of a plea agreement, a Class 6 felony charge of simple assault on a law enforcement officer was dismissed. He was sentenced to 91 days in jail, with credit for one day already served and the remainder suspended. He was also ordered to pay a $350 fine.

* Jami Fleury, 45, of Mitchell, pleaded guilty to possession of a controlled substance (meth), a Class 5 felony. As part of a plea agreement ,a Class 2 misdemeanor charge for possession of drug paraphernalia was dismissed. Fleury is scheduled to be sentenced in two weeks.

* Wetu Kiyukan, 29, of Mitchell, appeared in court for a status hearing to request a new attorney. Kiyukan faces several drug-related charges, including manufacturing/distributing/possessing meth, as well as distributing/possessing drugs in a drug-free zone, both Class 4 felonies; and possession of methamphetamine, a Class 5 felony. Her jury trial has been rescheduled from December to February.

* Elmer Navarro, 29, of Sioux Falls, failed to appear in court on a third-offense DUI charge, a Class 6 felony. He is also facing two Class 2 misdemeanors for running a red light and driving with a suspended license. A $2,000 bench warrant was issued for his arrest.

* Dominic Northrup, 27, of Mitchell, appeared in court for a status hearing to request a new attorney. Northrup faces multiple charges, including resisting an officer, failure to maintain financial responsibility, and having an open alcoholic beverage container, all Class 2 misdemeanors; driving with a revoked license and obstructing police, both Class 1 misdemeanors; and a fourth-offense DUI charge, a Class 5 felony. His case was continued for two weeks.

* Stephvon Bailey, 35, of Mitchell, pleaded guilty to distributing/possessing drugs within a drug-free zone, a Class 4 felony . As part of a plea agreement, two other Class 4 felonies, manufacturing/distributing/possessing drugs and conspiracy to manufacture/distribute/possess drugs, along with two Class 5 felonies for possession of a controlled substance and keeping a place for drug use or sale were dismissed. The court ordered a pre-sentencing report. Bailey is scheduled to be sentenced in January.

* Will-Anthony Owen Jellis, 46, of Sioux Falls, appeared in court for a bond hearing. Jellis faces charges for impersonating an officer, a Class 1 misdemeanor; two counts of domestic abuse aggravated assault and two counts of aggravated assault by strangulation, both Class 3 felonies; and violation of a protection order, a Class 6 felony. His bond was reduced to a PR bond. A jury trial is scheduled for February.
