Former Party City employees file class action lawsuit over September layoffs

Former Party City employees have filed a class-action lawsuit against the company, claiming the company violated worker protection laws when mass layoffs occurred in September, court documents show.

In the lawsuit, “Sonia Agostino, on behalf of herself and all others similarly situated vs. Party City Holdings,” the plaintiffs allege that the defendant violated the WARN Act and the NJ WARN ACT when the company laid off approximately 181 employees on September 17. 2024, the lawsuit said.

The class action members allege that their former employer fired them without “at least 60 days prior written notice as required under the WARN Act and without at least 90 days prior written notice as required under the NJ WARN Act,” as stated in the lawsuit .

The plaintiffs said they were notified of the termination on September 17 and subsequently terminated on the same day.

Party City Corporation could not be reached for immediate comment.

The former employees are seeking damages equal to 90 days’ wages. The lawsuit also states that “plaintiffs are entitled to damages equal to 200% of their wages owed under the New Jersey Wage Payment Law.” The lawsuit said the company also failed to provide “written notice of 60 days of severance.”

Party City is a company with 25 stores throughout New Jersey and is headquartered in Woodcliff Lake. Before the mass layoffs in September, Party City employed about 328 people, the lawsuit said.

The lawsuit was filed on September 24, 2024. Robert Davis of Davis Law Center and Ezra Salami of Ezra Law PC will represent the plaintiffs in the case.
