Fulton County prosecutors this week asked a Georgia appeals court to reinstate six charges filed against former President Donald Trump in his indictment for attempting to overturn his 2020 election loss in the state.
In a lawsuit, prosecutors from the office of Fulton County District Attorney Fani Willis asked that the Court of Appeals reinstate six charges, including three against Trump, that she said Judge Scott McAfee improperly dismissed earlier this year.
“The district court erred by quashing six counts of the indictment in this case, each of which alleged the crime of solicitation of a violation of oath by a public official,” they wrote.
The charges in question, prosecutors wrote, involve a suspect taking a criminal step toward committing another crime.
“The court erred in requiring the State to provide specific details regarding the target crime, namely violation of oath by a public servant, which is not required for a charge of solicitation of violation of oath by an official,” she added.
The three charges against Trump include accusations that he solicited Georgia House Speaker David Ralston and twice Georgia Secretary of State Brad Raffensperger.
Prosecutors have also requested an oral hearing in the case.
Steve Sadow, Trump’s lead attorney in the case, said in a statement Wednesday that prosecutors’ order was “simply wrong under the law.”
“The district court’s dismissal order correctly found that the state failed to sufficiently plead the allegations in the dismissed charges under Georgia law,” Sadow said.
McAfee in March dismissed six of the charges in the indictment against the former president and several of his co-defendants, including former White House chief of staff Mark Meadows and former Trump lawyer Rudy Giuliani. The judge said prosecutors failed to provide sufficient details about the underlying crime the suspects requested, leaving the suspects with insufficient information to prepare their defense.
McAfee dismissed three of the first 41 charges last month, including two against Trump.
Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.
The case has been stayed due to efforts to disqualify Willis as a prosecutor.
