Man shot by police now in jail; 2 Xenia officers on leave

July 3 – A 23-year-old man who was shot and wounded by Xenia police officers on Sunday was booked into the Greene County Jail Tuesday night after being released from Miami Valley Hospital.

Kyle Eugene Berry’s bail was set at $500,000 during his arraignment Wednesday in Xenia District Court on two counts of aggravated assault, online court records show.

Two Xenia police officers are on administrative leave as part of “routine procedure” in connection with an officer-involved shooting Sunday. The police shooting was the second in the Dayton area in 24 hours.

At around 7:25 a.m. on Sunday morning, police were called to an apartment complex in the 100th block of South Orange Street in Xenia, just south of where Bellbrook Avenue turns into West Second Street.

The 911 caller reported a man with a gun was shooting inside the apartment complex. The manager of the Greene Manor Apartments complex told police the person also pointed a gun at him, according to the initial police report.

Six Xenia police officers responded, as did several officers from the Greene County Sheriff’s Office. Officers saw the man pointing a gun at police and opened fire, the Xenia Police Division said.

The person who was shot, identified as Berry, could face additional charges once the case is presented to a county grand jury, police said.

The Ohio Bureau of Criminal Investigation was asked to conduct the criminal investigation.

The two officers involved in the shooting were suspended as a “routine” part of an officer-involved shooting, Xenia police said. They have not been identified. One has 16 years of law enforcement experience and the other has 10 years of law enforcement experience.

“The Xenia Police Department will continue to cooperate with BCI and the Greene County Prosecutor’s Office as they conduct their investigation,” police said.
