One of New York’s wealthiest counties is suing to shut down Bark Air days after its first canine charter flight took off

Bark Air, the charter company for spoiled puppies, could be locked in the kennel just days after the first flight.

Westchester County in New York has sued the company behind the charter service, saying it violated restrictions on the use of airports. Officials hope to ban the airline from operating in the private jet area and require it to operate out of the passenger terminal, where space is much more limited.

Commercial flights make up a small portion of traffic at Westchester airport, where nearly 60% of flights are business aviation, according to the website.

The province also cited Talon Air, the private jet service that partners with Bark (whose main business is monthly treat and toy subscriptions for dogs) on the flights.

Bark said Fortune it “does not comment on litigation, but we do not believe this will impact our business.”

Bark Air plans to offer flights from New York City to Los Angeles and London with one-way flights costing about $6,000 to $8,000. Prices vary depending on routes and time of year. People don’t pay anything for their ticket.

Bark Air has said it hopes to offer lower prices as demand increases and more flight routes are added. The lawsuit against Westchester County could get in the way of that.

Once a flight is booked, Bark Air will contact the owner to collect information about their canine passengers, including size, temperament and any preferences. There are typically 10 to 15 seats on each flight, but the total number of passengers (human and otherwise) varies depending on the size of the dogs.

Westchester County says the airline is violating county law by operating an aircraft with more than nine seats from its private jet terminal. However, the province is facing legal action of its own as three other airlines have sued it, saying the restrictions on the use of airports on charter flights violate federal law.

To date, no ruling has been made on these claims.
