Supreme Court Blocks Nevada Green Party Candidacy for 2024 Ballot Access

The U.S. Supreme Court on Friday rejected the Nevada Green Party’s attempt to get its candidates on the ballot for the 2024 elections in the pivotal state.

The party, represented by Donald Trump’s impeachment lawyer Jay Sekulow, asked the judges for emergency relief for polling access in Nevada, where presidential candidate Jill Stein could win votes from Democratic candidate Kamala Harris.

The Green Party is challenging a Sept. 6 Nevada Supreme Court ruling that its candidates could not be on the ballot because of a recordkeeping error, even though the party made the error after receiving incorrect information from the Nevada Secretary of State’s office. The state Supreme Court ordered the district court to issue an injunction, which it did that day, directing the secretary of state to keep the party’s candidates off the ballot.

In an unsigned order Friday, the U.S. Supreme Court left the state court’s decision intact.

Both the Nevada State Democratic Party and the Nevada Secretary of State opposed the Green Party’s attempt to reach the Supreme Court.

Particularly in swing states, third-party candidates can be decisive for the outcome. For example, the Green Party could potentially win votes that would otherwise go to the Democratic candidate, Vice President Kamala Harris.

Last month, a divided Supreme Court partially sided with Republicans in their bid to enforce an Arizona law that requires documentary proof of citizenship to vote.
