The law requiring California bars to have anti-rape drug testing kits will soon go into effect

Bars and nightclubs across California will soon be required to have date rape drug testing kits under a new law that takes effect this summer.

The California Department of Alcoholic Beverage Control reminded establishments Tuesday that the measure, known as Assembly Bill 1013, will take effect July 1. AB1013, authored by Assemblymember Josh Lowenthal (D-Long Beach), passed unanimously in the Legislature last year.

Under AB1013, companies must offer the kits, which can detect GHB and other substances known as “roofies” in beverages. The kits can be for sale or offered to customers for free.

Establishments must also post signs that read: “Don’t be confused! Beverage fortification test kits are available here. Ask a staff member for more information.”

The measure affects establishments with a “Type 48” license, including 2,400 bars and nightclubs in the state. Bars and clubs that don’t follow the rules could face administrative action that will affect their licenses, the agency said.

Department of Alcoholic Beverage Control officials said they do not sell or supply testing kits and do not officially endorse any specific company that does.
