ST. LOUIS PARK, Minn. – The indictment says a driver from St. Louis Park who two pedestrians hitwhich killed one and seriously injured the other, failed to brake before the crash.

Jeremy Sherman, 38, was charged with criminal vehicular homicide and criminal vehicle operation — both while under the influence of alcohol — according to a criminal complaint filed Tuesday in Hennepin County.

The crash happened Monday shortly after 6 p.m. on the 7500 block of Excelsior Boulevard. Officers found a 51-year-old woman and a 60-year-old man had been hit. The woman, identified by family as Manes Thach, died at the scene. She would have turned 52 on Tuesday. The man, a colleague of Thach’s at a nearby printing plant, was hospitalized with serious injuries.

According to the criminal complaint, witnesses told police that the vehicle that struck the two pedestrians did not appear to slow down or attempt to brake before hitting them.

Officers reported a “strong odor of alcohol” coming from Sherman’s breath when they spoke to him after the crash. He reportedly denied drinking alcohol and claimed he had just gotten off work.

After conducting field sobriety tests, police asked Sherman to provide a preliminary breath test sample, which the charges state he refused.

Officers arrested Sherman and obtained a warrant to take a sample of his blood.

Sherman’s first court appearance is scheduled for Jan. 2.
