Dec. 16 – A Trotwood man will spend up to 12 years in prison for sexually assaulting two girls in Dayton – a 16-year-old he allegedly attacked at gunpoint and a girl younger than 13.
Jeremiah Avery, 20, was sentenced Thursday by Montgomery County Common Pleas Judge Mary Montgomery to eight to 12 years in prison in one case, and five years for the second case, to be served concurrently, the Montgomery County Prosecutor’s Office said.
Avery pleaded guilty on November 22 to rape and gross sexual imposition of a person under the age of 13. As part of his plea, two additional rape charges were dismissed.
He was also designated a Level III sex offender. At the highest level, he will have to register his address with the local sheriff’s office every 90 days for life.
Dayton police opened an investigation after a woman reported her 16-year-old daughter had been sexually assaulted on Jan. 12, according to an affidavit filed in Dayton Municipal Court.
During a forensic interview, the teen said she was hanging out with Avery when he allegedly started waving a gun.
“Jeremiah pointed the gun at her and said he was going to kill her, her mother and her brother,” the statement said.
He then allegedly sexually assaulted her.
In the other case, Avery was accused of forcing the younger girl to perform sex acts on him on Oct. 16, 2023, prosecutors said.
