Utica police release bodycam footage of the fatal shooting of Nyah Mway

Utica police have released bodycam footage from the night 13-year-old Nyah Mway was shot and killed by police.

The footage – now available to watch on the department’s YouTube channel – is divided into six separate videos of varying lengths. The shortest video is 2:27 long, while the longest is 23.30 minutes long.

Police also released photos of the pellet gun Nyah was allegedly carrying when he was shot by police.

“As always, we are committed to transparency and earning the public’s trust in our investigations,” the Utica Police Department said in a statement Saturday about the officer-involved shooting. “As much information as is permissible will be released during this process.”

The shooting

According to authorities, on Friday, June 28, at approximately 10:18 p.m., officers conducted a pedestrian stop on two juveniles in the 900 block of Shaw Street.

One of the youths, Nyah, fled from police. According to police, Nyah showed what appeared to be a gun during the chase.

Police said they seized a replica GLOCK 17 pistol, which was determined to be an air rifle.

Nyah was taken to Wynn Hospital, where he died from his injuries.

Bodycam footage

The bodycam footage belongs to three officers, according to the released footage and a check of Utica Police Department online records. These are Patrick Husnay, Bryce Patterson and Andrew Citrini.

The footage begins as officers approach Nyah and the other juvenile, who was riding a bicycle. Patterson is seen in the footage telling the teens that they are being pulled over because one teen was riding a bicycle in the road while Nyah was walking nearby.

Nyah, who initially had his hands in the air, was then seen running away after officers asked if they could frisk him to see if he was carrying any weapons.

Patterson and Husnay ran after Nyah, with Patterson taking the teen down after a brief chase as officers could be heard shouting, “He’s got a gun.”

Husnay had drawn his weapon and appeared to shoot Nyah as he lay on the ground, according to released bodycam footage.

“It was one shot,” Husnay can be heard saying according to the released footage. “It was me.”

According to documentation on the department’s website, Husnay joined the Utica Police Department in May 2018.

All three officers involved in the incident have been placed on paid administrative leave pending the investigation.

Section 70b of the New York State Executive Law provides that the New York State Attorney General’s Office of Special Investigations shall be in charge of criminal investigations into officer-involved shootings.

The attorney general’s office announced in a statement Saturday that it had launched an investigation.

The Utica Police Department, along with the Professional Standards Unit, is conducting an internal investigation to determine whether policies, procedures and training were followed.

In addition, UPD will work closely and openly with the City of Utica’s Public Safety Advisory Committee.
