CHICAGO (CBS) — One of the women hit by gunfire during White Sox game at Guaranteed Rate Field filed a lawsuit against the Chicago White Sox last Thursday.

According to law firm John J. Malm and Associates, the woman, identified as Jane Doe, accused the team of “negligence and recklessness” and failure to enforce the “No Firearms” policy after a weapon was brought into the stadium and discharged during the game, striking two women on August 25, 2023.

The incident happened in the fourth inning of the Sox’ game against the Oakland A’s. Some of the aftermath was captured on the game’s broadcast. A camera trained on Section 162 captured the moment fans screamed for help after a 42-year-old woman was shot in the leg and a 26-year-old woman was grazed in the stomach.

“The defendants had a duty to protect those present from foreseeable dangers, including firearms,” said attorney John Malm. “Our client, an innocent bystander, suffered serious injuries as a result of the failure to take proper safety precautions, we believe.”

The law firm denied rumors that the woman smuggled a gun into the stadium and accidentally shot herself. That statement was not confirmed by Chicago police. It is still unclear whether the shots came from inside or outside the park.

According to the company, the woman is seeking $50,000 in damages for personal injury, financial loss and other damages, including past, present and future losses as a result of the shooting.

At Your Service LLC and The Illinois Sports Facility Authority were also named in the lawsuit.

The Chicago White Sox did not immediately respond to a request for comment on the lawsuit.
